The development of artificial intelligence (“AI”) technologies has made it possible to create content (texts, images, computer programs, music and video) from scratch using only generative AI (ChatGPT, Claude, Gemini, Grok, DeepSeek, etc.).

This raises questions about the legal status of such works and the possibility of their protection by copyright both in the Republic of Belarus and all over the world.

Legal framework

The main normative act governing copyright in Belarus is the Law of the Republic of Belarus dated May 17, 2011 No. 262-Z “On Copyright and Related Rights”. Article 4 of this Law explicitly states that the author of a work may be an individual who created it.

From this definition it follows that at the moment, content created entirely by AI without human participation cannot be protected as a work of authorship. However, a reasonable question arises: isn’t the use of generative AI associated with human participation, since it is the human who makes the initial request with instructions (“prompt”)? Will this be sufficient to obtain protection? If not, what human participation will be considered sufficient to obtain protection? We will try to answer these questions below, based on Belarusian and international experience.
